A Houston-based egg roll producer has been shut down by the federal government for producing food under unsanitary conditions that could cause botulism or listeriosis.

Chung's Products, which produces a variety of Asian frozen foods including spring rolls, potstickers and entrees, was permanently enjoined this month from operating until company officials take remedial action as required by the federal court order.

The injunction means that Chung's should not receive, process, prepare, pack, hold or distribute food from any facility.

It is unclear whether consumers have been sickened by the products, which are emblazoned with "Chung's" in ribbony red script and sold in several states, including Texas.

Besides the company, Chung's president Charlie A. Kujawa and Gregory S. Birdsell, former director of quality assurance, are named in the injunction. Houston federal judge Melinda Harmon issued an order finding that all three had violated the U.S. Food and Drug Administration's Food, Drug and Cosmetic Act.

In her April 3 decision, Harmon concluded that there is a reasonable possibility that the Chung's products were contaminated with filth as well as unsafe and injurious to health. The court also found that the company's challenges to FDA testing methods were "frivolous" and demonstrated a "wanton disregard of a potential food safety hazard."

The dispute dates back to at least 2005, when the FDA began documenting an unsafe food manufacturing environment at the Houston factory, including air-conditioning condensation dripping into egg roll filling and unclean work surfaces. After the company failed to respond to safety concerns identified by the FDA, the agency took the unusual step of suing in 2010 over the preparation of shrimp egg rolls.

"We are disappointed and puzzled that our concerted and repeated attempts to work with the FDA to resolve disagreements stemming from a July 2009 inspection have ended in a lawsuit," Kujawa said in a statement at that time.

Chung's officials have been fighting the court filing for three years.

Kujawa, Birdsell, other company officials nor their lawyers could not be reached immediately for comment on Monday. According to the company's web site, Kujawa and Birdsell joined Chung's in 2006.

"We will continue to take strong action against those who risk the safety of the American food supply by manufacturing and storing products under insanitary conditions and flouting important food safety rules," Acting Assistant Attorney General Stuart F. Delery said in a Justice Department news release issued on Monday. "The court's ruling ensures that these defendants will take appropriate steps to ensure that consumers who purchase their foods will receive products that are prepared, packaged and held under sanitary conditions as required by law."

How efficient is our government at protecting us if they let this continue for over 4 years before shutting it down?

How many children were made sick?

They sold them at Kroger for years. That's where we first found them.

HEB, Randalls, everywhere carried them, they were a national brand.

Think of all the good stuff you were eating.

Kroger still has shelves full of Chung's egg rolls.

they have been shut down, they haven't been recalled but I would imagine they aren't great sellers right now and probably some places will be getting them off the shelf soon.
