The Hearing before the Texas Public Utility Commission regarding Kingwood Lakes parments unlawful billing and charges is schedule for September 6, 2016 at 9AM. If you are a current or former tenant of Kingwood Lakes aprtments, you can participate in the hearing. The following is the instructions to participate.

How to participate in proceedings:
One way to become involved in a case before the Commission is as an "intervenor." An intervenor is a person who, upon showing a justifiable interest, is permitted to become a party to the proceeding. Intervenors are full participants in the proceeding and make legal arguments, conduct discovery, file testimony, cross-examine witnesses, and are themselves, if they testify, subject to cross-examination by the other parties in the case. An intervenor should file a motion to intervene with the PUC, conforming to Commission rules and practices, and serve the motion on all parties of record. The motion to intervene can be in the form of a letter.

As many of you may know in December 2015, I filed a formal complaint with the Texas Public Utility Commission against Kingwood Lakes Apartments.    The PUC determine that Kingwood Lakes overcharged some tenant for water and waste water charges.  If you or someone you know was a single tenant, living in a one bedroom or two bedroom apartment you may be entitiled to as must and $300 or more in overcharges, depending on how long you lived in the complex.  The final order paragraph is below:

Within 30 days of this Order, Kingwood Lakes is ordered to refund $359.77 to Ms. Bittone
for water and wastewater services overcharges.
3. Within 30 days of the date this order is signed, Commission Staff shall establish 'a
compliance docket to determine under 16 TAC § 24.125 if the overbilling determined in
this docket affected all tenants, and if so to calculate an adjustment for all affected tenants'
bills.
4. Within 60 days the date this order is signed, Kingwood Lakes shall calculate and fully
account for all over- or under-charges to tenants for water or wastewaters, consistent with
the requirements of 16 TAC 24, subchapter H. Kingwood Lakes shall file that information
in the compliance docket established by Commission Staff under ordering paragraph 3.
This information shall provide enough detail so that the amounts to be refunded or
surcharged to each tenant, and the appropriate time-period for making the refunds or
surcharges, may be determined.
