> Subject: Please read! More info about Sex offender in Kings River
>
> I spoke to the DA, John Wakefield, who is handling this case. The Judge's office is referring concerns to the DA but the DA told me that the best thing we can do is to write a letter voicing our concerns and get it in the mail tomorrow. The case is suppose to go to court next week and the letters will show how there are a lot of families with children who live in Kings River and that we fear for our children's safety. He will bring the letters to the hearing with him. Please stop what you are doing and write a letter for all our children's safety. Please pass this on to other Kings River residents.

> Sex offender re-arrested for violating probation
> ATASCOCITA - A 20-year-old Kings River man was booked into Harris County Jail May 10 after a motion to adjudicate was filed in connection with a 2009 charge of possession of child pornography and a warrant was issued for his arrest.
> According to Harris County court documents, Kody Devillier was taken into custody for violating the conditions of his probation.
>
> Devillier was originally indicted by a grand jury in March 2009, after Precinct 4 Constable’s Office investigators discovered child pornography on his computer. At the time, Precinct 4 Internet Crimes Division Sgt. Gary Spurger wrote in a probable cause statement that Devillier, who had been arrested in May 2008, obtained child pornography through an online peer-to-peer sharing network.
>
> “One of the videos that [Devillier] reviewed, it contained a pre-pubescent child, approximately 4 years of age, being [...] penetrated by an adult male. [I ] noted that the child can be heard screaming and crying on the video,” the probably cause statement reads. “[I] also observed digital images that contained children under the age of 18, at the time the image was made, engaging in deviate sexual intercourse, the lewd exhibition of the genitals and bestiality.”
>
> A few months after charges were brought against Devillier, he was sentenced to 5 years probation, counseling, and 200 hours of community service, according to court records. Devillier was prohibited from unsupervised use of the computer and the Internet, as well as the unsupervised contact with children under the age of 14. Devillier was also ordered to register as a sex offender. According to Texas Department of Public Safety records, he was deemed at moderate risk level for re-offending.
>
> County documents show Devillier was subjected to a polygraph exam on March 31. The results indicate Devillier failed to remain in Harris County as ordered.
>
> Records also show Devillier “admitted to having contact with minors under the age of 14 while at church,” “admitted to viewing pornography on two different occasions,” and “admitted to accessing the Internet via his mother’s cell phone.”
> According to John S. Cossum, Devillier's attorney, Devillier self-reported his probation violations.
> "It is not expected that his deferred adjudication will be revoked, although that is ultimately up to the judge. The expectation is that he will be released [after] approximately 30 days in jail with additional conditions on his probation that have already been recommended," Cossum said. "His therapist, who he sees as a condition of his probation through Harris County Department of Community Supervision, has recommended that he be continued on probation."
> As of Friday morning, Devillier was being held in the Harris County Jail without bond.

What will the letter do, though? Will they keep him under lock and key? Force his family to move out of Kings River?

humbleteacher --- 14 years ago -

It will prevent his early release, as his therapist is recommending.

How much longer can they keep him?

And isn't there a law about how close you can reside next to a park or school as a registered sex offender? That corner seems awfully close! :/

MyPiggyBank --- 14 years ago -

the letter will show the judge that the community is concerned about a minimal punishment. The DA is requesting adjudication and to put him in prison but the judge could rule for 30 days if he wants to. The judge needs to know how Kings River is a young neighborhood full of families with young children. A repeat offender should get more than a slap on the wrist.

soccer14drama --- 14 years ago -

I wonder how Kings River fits into the law about offenders living by parks since we are not in city limits. The first house on Crimson Oak, right across from the big park, had a registered offender living there - they were renting. They have moved on and the house is now for sale. My son said the bus can no longer stop at crimson oak and water point because of this young man.

I consider myself a very peaceful person.... but reading this makes me want to rip this guys throat out.

He is not getting what he needs, Probation? And he sits at home & pulls porono on his computer. He is endangering kids in the area where he lives.
I always wonder when the parents aren't mentioned. Where are they? Not a good situation, but for God's sake put him away with counceling & see if the parents can step up to the plate to help! How did he get to this place???

Dorothy Parker --- 14 years ago -

I don't understand how they can let him out in 30 days given the graphic nature of what he's been viewing! And as far as seeing a therapist, what a joke! He can't be rehabilitated of this...it's only a matter of time before he attacks a child, if he hasn't already.... :(

Bornanraisedkw --- 14 years ago -

Ugh sickens me every time I read about what was viewed.

I'm pretty sure the parents are the ones that own the house. They had the bright idea to house him right by the park in a family neighborhood. Someone that gets pleasure from viewing the rape of a four year old child is very sick. To think that any judge would just let him out is disheartening.

Dorothy Parker --- 14 years ago -

I'm glad I know what he looks like...

If I ever see him hanging around the park, I'll make sure everyone there knows who he is!

Dentalgal --- 14 years ago -

I thought the law stated they couldn't live within a certain distance of a playgroud as well, not just Houston Law but state law.

irrelevant. pointless.
if he isn't kept behind bars the law needs to be changed.

crazypinetrees --- 14 years ago -

They are not allowed to live within 500ft? i think from a school, park or anywhere children congregate.

MyPiggyBank --- 14 years ago -

One more thing...the DA said that letters with names carry more weight but he understands some of the concerns from residents not wanting to put theirs on there. He said you may submit two letters, one with your name to be kept on his files if he needs them and one that states "Name Withheld By Author." If you do the name withheld you could also put the street you live on to give it a little more weight but leave your house number off.

Too bad the community couldn't join together like this against the young man who lives in Mills Branch near Hidden Hollow Elementary. He and his brother are unregistered sex offenders but because Mommy is on the school board, they are still free men with high school diplomas.

Oh, and criminal records that are pretty long.

NewMommy --- 14 years ago -

Not only does he live pretty close to KR park, but there is a set of swings to the left and the right of his house on Upper Lake. We don't even go to one set of swings anymore because I don't want to push the stroller past his house. I don't know the distance to each of those though.

Tell me more. I've never heard this story. My little one goes to Hidden Hollow.

You said court is next week. If a letter goes out today, by the time it goes through the mailroom process, will it make it in time?

NewMommy --- 14 years ago -

I bumped the other thread too. In case anyone wanted to click on the link or see any comments.

NewMommy --- 14 years ago -

I wonder if his 10 Facebook friends know about his history....especially when they post pictures of their nephews, neices, their own kids...
